1. מה האתר עושה ומה הוא לא עושה

האתר אינו מארח, מעלה או מעתיק סרטונים או הקלטות. הסרטונים נמצאים ב-YouTube ומוצגים באמצעות נגן מוטמע. האתר מחזיק קישורים וכותרות בקטלוג חיפוש.

2. בעלי זכויות: איך מבקשים להסיר פריט

אם אתה בעל זכויות או מוסמך מטעמו ואתה סבור שפריט בקטלוג פוגע בזכויותיך, שלח אלינו ל-[דוא"ל לפניות] הודעה שכוללת:

• זיהוי היצירה המוגנת והסבר על הזכות שלך בה.
• הקישור לסרטון ב-YouTube (או מזהה הסרטון) שברצונך להסיר מהקטלוג.
• שם, כתובת, דוא"ל וטלפון ליצירת קשר.
• הצהרה בתום לב שהשימוש שהאתר עושה אינו מורשה על ידי בעל הזכויות, ושהפרטים בהודעה מדויקים ושאתה מוסמך לפעול מטעם בעל הזכויות.
• חתימה (גם אלקטרונית).

3. מה נעשה בהודעה

נבדוק את ההודעה ונשיב בתוך 7 ימי עסקים. אם ההודעה מנומקת, נסיר את הפריט מהקטלוג ונחסום אותו מהוספה מחדש. אנחנו עשויים להעביר את ההודעה למי שהעלה את הסרטון, ולבקש הבהרות.

הסרה מהקטלוג שלנו אינה מסירה את הסרטון מ-YouTube. להסרה מ-YouTube יש לפנות ל-YouTube לפי הנוהל שלהם.

4. הודעה שגויה

מי שמגיש הודעה בכוונה מטעה עלול לשאת באחריות לפי הדין. אם סברת שהסרה נעשתה בטעות, פנה אלינו ונבחן את הדבר. [לבדיקת עו"ד: הליך התנגדות, בהתאם לדין הישראלי]

5. הפרות חוזרות

נפעל להסרה של פריטים שחזרו והוזנו שוב, ונחסום משתמשים שמנצלים לרעה את השירות.

1. What the Site does and does not do

The Site does not host, upload or copy videos or recordings. The videos are on YouTube and shown through an embedded player. The Site keeps links and titles in a search catalog.

2. Rights holders: how to ask for removal

If you are a rights holder or authorized to act for one and believe an item in the catalog infringes your rights, send [Contact email] a notice that includes:

• Identification of the protected work and an explanation of your right in it.
• The YouTube link (or video ID) of the item you want removed from the catalog.
• Your name, address, email and phone.
• A good-faith statement that the Site’s use is not authorized by the rights holder, that the information in the notice is accurate and that you are authorized to act for the rights holder.
• A signature (electronic is fine).

3. What we do with a notice

We will review the notice and reply within 7 business days. If the notice is well founded, we will remove the item from the catalog and block it from being added again. We may pass the notice on to the uploader and ask for clarification.

Removal from our catalog does not remove the video from YouTube. To remove it from YouTube, contact YouTube through their procedure.

4. Mistaken notices

Someone who files a deliberately misleading notice may be liable under the law. If you believe a removal was made by mistake, contact us and we will look into it. [For counsel: objection procedure under Israeli law]

5. Repeat issues

We will remove items that are entered again and block users who abuse the service.
